"Candidate" refers to a person who accesses the Service to take a Test Session.

"Content" includes all text, information, materials, data, software, applications, images, audio, or video, as well as metadata relating to any such content, provided by us or you in relation to the Site.

"Initial Term" refers to the initial term of the Agreement as specified in the Sign-up Form.

"Paid Plan" refers to the paid Service you subscribe to by submitting your details and making payment via the Site or by completing and signing the Sign-up Form (or both).

"Policies" include the following documents displayed on the Site: Privacy Policy, Cookie Policy, and Data Processing Agreement.

"Service" refers to the intelligence test-taking service accessible through the Site.

"Sign-up Form" is the form you complete when subscribing to the Site.

"Task(s)" refers to exercises in the Test created by IQgoogol.

"Test" is a set of tasks selected by IQgoogol for the Candidate.

"Test Session" is an attempt made by a Candidate to solve a Test.

"You" refers to an Account Holder, their employees, agents, or anyone authorized by us to use the Service.

(Registered in Vietnam: National Company Code 0110633686, DUNS 646428093, Floor 03, Ha Thanh Plaza Building, 102 Thai Thinh, Trung Liet Ward, Dong Da District, Hanoi City, Vietnam). Should you continue to use our service, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy govern Global IQ Rubik Company Ltd, relationship with you in connection with our service.

If we have reason to believe that there is likely to be a breach of security or misuse of the Website with your email address, we may require you to verify your email address or we may suspend the release of the relevant personal information. Until you have verified your email address you may not be able to access certain parts of the Website and information. You agree that all personal information that you supply to us will be accurate, complete and kept up to date at all times. We may use the information provided to us to contact you. You may not provide more than one email address with the Website. We reserve the right at our discretion to delete or cancel the usage of any person who in our opinion uses more than one email address at any time. You are responsible for keeping your email account and login details confidential to ensure that nobody has access to your survey results. Do not share such information with anyone as whoever has it will have full access to all your information that we share with you via email. If you decide to print the survey results or you share the results with someone, it is at your own risk to do so (e.g. if someone finds your printed copy of the test results).

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 – GENERAL CONDITIONS

The content and information of the Service (including data, text, sound, video, image or computer code), as well as the infrastructure used to provide such content and information, is the property of Gloabl IQ Rubik Company Ltd or has the corresponding authorizations for its use.

Furthermore, modification, reproduction, duplication, copying, distribution, sale, resale and other forms of exploitation for commercial or equivalent purposes of the Service are prohibited.

Any other use of the content of the Service requires our prior written consent.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We'll process data provided by you in accordance with our Privacy Policy and Data Processing Agreement. You're responsible for the accuracy and legality of any data or content. You and us agree to bring any dispute on an individual basis only, and not as a class or collective action. There will be no right or authority for any dispute to be brought, heard or arbitrated as a class or collective action. Class action lawsuits, class-wide arbitrations, private attorney-general actions, and any other proceeding where someone acts in a representative capacity aren’t allowed. Nor is combining individual proceedings without the consent of all parties.

By agreeing to these terms and conditions, you hereby waive your right to participate in any class action lawsuit or class-wide arbitration against Global IQ Rubik Company Ltd. or its affiliates. You agree that any dispute, controversy, or claim arising out of or related to your use of our products or services will be resolved on an individual basis, and you will not consolidate or seek class treatment for any claim with respect to other users.

If any court or arbitrator determines that the class action waiver set forth in this section is void or unenforceable for any reason or that arbitration can proceed on a class basis, then the disputes, controversies, or claims that would otherwise have been subject to this class action waiver shall be exclusively brought in the state or federal courts located within the jurisdiction of Vietnam and international, and you agree to submit to the personal jurisdiction of such courts.

SECTION 7 – PURCHASE

We offer digital content for purchase on the Website. At the time you place any order for which payment is required you must give authority for payment. We may take payment from you at any time between you placing the order and us providing you the goods (e.g. via email) or you requesting the download of digital content. You will always be informed of the exact amount of the charge before you are able to proceed and complete your payment.

Your order is an offer to purchase from us. There will be no contract of any kind between you and us unless and until we actually take payment from you. At any point up until then, we may decline to supply the goods or digital content to you without giving any reason. If we take payment and subsequently fail to provide the goods or make the digital content available to you for any reason we will refund you in full.

The prices payable for the items that your order are clearly set out on the Website. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price provided that we notify you before we provide or make available the item concerned.
